Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Steady Moving Services ("Company," "we," "us," or "our") concerning your use of our moving services and website. By booking our services, accessing our website, or otherwise engaging with our company, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
Services Description
Steady Moving Services provides professional moving and relocation services, including but not limited to local moving within Los Angeles and surrounding areas, long-distance moving across California and interstate, packing and unpacking services, furniture disassembly and reassembly, and specialty item handling. The specific services provided will be outlined in your service agreement or quote. We reserve the right to refuse service to anyone for any reason at any time, particularly if we determine that the requested service poses safety risks or violates applicable laws.
Booking and Quotes
All quotes provided are estimates based on the information you provide. Final charges may vary based on actual services rendered, distance traveled, time required, and any additional services requested on moving day. Quotes are valid for thirty days from the date of issue unless otherwise specified. To secure your moving date, we may require a deposit, which will be applied to your final invoice. Deposits are non-refundable if you cancel within seventy-two hours of your scheduled move date, unless otherwise agreed in writing.
You are responsible for providing accurate and complete information about your moving needs, including the size of your home, number and type of items to be moved, access conditions at both locations, and any special requirements. Failure to provide accurate information may result in additional charges or inability to complete the move as scheduled.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in advance and confirmed in writing. We accept cash, credit cards (Visa, Mastercard, American Express, Discover), and debit cards. For long-distance moves, we may require a deposit at booking and payment of the remaining balance before or upon delivery. All prices are in United States Dollars (USD).
Late payments may be subject to interest charges at the rate of one and one-half percent per month or the maximum rate permitted by law, whichever is less. If we must engage collection services or legal action to recover unpaid amounts, you agree to pay all costs incurred, including reasonable attorney fees.
Cancellation and Rescheduling
If you need to cancel or reschedule your move, please contact us as soon as possible. Cancellations made more than seventy-two hours before your scheduled move date will receive a full refund of any deposit paid. Cancellations made within seventy-two hours of your scheduled move date will forfeit the deposit. Cancellations made on the day of the move will be charged the full estimated amount.
We will make reasonable efforts to accommodate rescheduling requests, subject to availability. Rescheduling fees may apply if the request is made within seventy-two hours of your scheduled move date. We reserve the right to cancel or reschedule your move due to circumstances beyond our control, including severe weather, equipment failure, or emergencies. In such cases, we will provide as much notice as possible and work with you to reschedule at no additional cost.
Liability and Insurance
Steady Moving Services is fully licensed and insured. We provide basic liability coverage at no additional cost, which covers your belongings at a rate of sixty cents per pound per article. This basic coverage is included in your moving cost. For more comprehensive protection, we offer full-value protection insurance, which can be purchased separately. Under full-value protection, if an item is lost, damaged, or destroyed, we will either repair it, replace it with a similar item, or provide a cash settlement for the current market value.
You are responsible for declaring any items of extraordinary value (such as jewelry, artwork, antiques, or collectibles valued over one thousand dollars) before the move. These items may require special handling arrangements and additional insurance coverage. We are not liable for damage to items not properly disclosed or items you choose to pack yourself, unless damage is caused by our gross negligence.
Claims for loss or damage must be filed in writing within nine months of the delivery date. We will investigate all claims promptly and respond within thirty days. Our liability is limited to the coverage option you selected and the terms outlined in your service agreement.
Prohibited Items
For safety and legal reasons, we cannot transport certain items, including hazardous materials (flammable liquids, explosives, corrosives, compressed gases, toxic substances), perishable food items, plants (for long-distance moves), pets or live animals, illegal substances or contraband, and items of extraordinary value without prior arrangement and additional insurance.
You are responsible for ensuring that no prohibited items are included in your shipment. If prohibited items are discovered, we reserve the right to refuse to transport them or to dispose of them at your expense. We are not liable for any loss, damage, or legal consequences resulting from prohibited items in your shipment.
Customer Responsibilities
You agree to be present or have an authorized representative present at both the pickup and delivery locations. You are responsible for ensuring that all items are ready for moving at the scheduled time, including items being properly packed (if you chose not to use our packing services), appliances being disconnected and prepared for moving, and pathways being clear and accessible for our movers.
You must inform us of any access restrictions, such as narrow doorways, stairs, long carries, or parking limitations, as these may affect the time required and cost of your move. You are responsible for obtaining any necessary permits or reservations for parking, elevator use, or building access at both locations. Failure to secure necessary access may result in delays and additional charges.
You must ensure that you have the legal right to move all items and that moving them does not violate any lease agreements, homeowner association rules, or other legal obligations. We are not responsible for any legal issues arising from your move.
Delays and Force Majeure
While we strive to complete all moves on schedule, delays may occur due to traffic, weather conditions, equipment issues, or other unforeseen circumstances. We are not liable for delays caused by factors beyond our reasonable control. In the event of a significant delay, we will communicate with you promptly and work to minimize any inconvenience.
We shall not be liable for failure to perform our obligations due to force majeure events, including natural disasters, acts of God, war, terrorism, civil unrest, government actions, strikes, epidemics, or other events beyond our reasonable control. In such cases, we will work with you to reschedule your move as soon as reasonably possible.
Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from our services shall not exceed the amount you paid for those services or the applicable insurance coverage limit, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
Dispute Resolution
We are committed to resolving any disputes amicably. If you have a complaint or concern about our services, please contact us immediately so we can work to resolve the issue. If we cannot resolve a dispute through direct communication, you agree to first attempt to resolve the dispute through mediation before pursuing litigation.
Any disputes arising from these Terms or our services shall be governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for the resolution of any disputes.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Steady Moving Services or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
Entire Agreement
These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Steady Moving Services regarding our services and supersede all prior agreements, understandings, and communications, whether written or oral. Any modifications to these Terms must be made in writing and signed by both parties.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically to stay informed of any updates.
